The secretary of state must issue a residence card for a person who is not an EEA national.

1. The secretary of state must issue a residence card to a person who is not an EEA national and is the family member of a qualified person of an EEA national with a permanent right of residence under Regulation 15 on application and production of

a) a valid passport
b) proof that the applicant is such a family member.

The secretary of state must issue a residence card to a person who is not an EEA national but who is a family member who has retained the right of residence.

In order for the Home office to issue a non EEA national with a residence card the following must be met;

1.The applicant must produoe the passport or ID card of the EEA national family member together with evidence of his or her relationship.

2. The applicant would also submit a valid passport where this is unavailable a H/O issued identity document. Evidence must be produced that the EEA national is exercising a treaty right in the UK or has a permanent right or residence under 2006 regulations.
