Getting Married in the UK

There is no requirement for migrants planning to marry in the UK to seek the permission of the Home office to do so. The Certificate of Approval scheme, introduced under the Asylum and Immigration (Treatment of Claimants etc) Act 2004, and designed to introduce such a requirement, was abolished on 9th May 2011. The scheme was held to be unlawful by the House of Lords in 2008 in the case of Baiai (2009).

One part of the original scheme does remain which is the requirement to give notice to marry or register the civil partnership at a 'designated office' . All registration offices in Scotland and Northern Ireland are designated offices, as are 76 offices in England and Wales. Both Parties will need proof of their name, age and nationality but there is no prescribed way of evidencing these.

Registrars have a duty under s24 of the Immigration and Asylum Act 1999 to report to the Home Office any marriage that they have reasonable grounds for suspecting to be a sham marriage. Under S24(5) 'sham marriage is defined thus'.

5) A marriage (whether or not it is void) is a Sham marriage if;
a) either or both of the parties to the marriagof one is not a relevant national.
b) there is no genuine relationship between the parties to the marriage, and
c) either or both, of the parties to the marriage enter into the marriage for one or more of these purposes.
d) avoiding the effect of one or more provisions of United Kingdom immigration law or the immigration rules.
e) relevant national means;

a) British citizen
b) a national of an EEA State other than the United Kingdom
c) a national of Switzerland

'United Kingdom immigration Law' includes any subordinate legislation concerning the right of relevant nationals to move between and reside in member states.

Many are finding difficulty finding the centre. Yes we are residential and many of you may find it difficult to locate. The directions to the Lady Margaret Road Legal Centre Southall Solicitors is as follows;

From Ealing- E7 Bus outside of Greenford High School and we are a small walk into Lady Margaret Road right next to the Roundabout turn Left or first exit if coming by car.

From Ealing- 407 or 207 to Southall Broadway and 120 bus across the road from the temple on Lady Margaret road will take you straight to our office opposite small Tesco.
From Greenford- 105 bus to Allenby road get off at Avon road bus stop and walk right next to Towers road on the corner.

From Southall- 120 Bus from King Street or from South Road direct to our centre and you should ask to stop next to Kenilworth Gardens bus stop we are just before the Tesco across the road.

From Northolt you can take a 95 or 120 straight down Lady Margaret road and this will leave you outside the parade of shops where you will need to turn left onto Hillside Road.

From April 2016, migrant workers will need to earn at least £35,000 to qualify for settlement in the UK. Non-EU migrants who have spent more than five yeas working in the country will be required to earn £35,000 per year or else face deportation, according to policy that comes in effect in April next year. for decades, settlement has been granted on the basis of length of time living in the UK, as well as pre-existing ties to the country. the policy is part of the government's determination to reduce  migration

We are planning to expand our current centre in West London to the affluent area of Knightsbridge and hope to attract further clients to our firm. With the success that we have achieved at West London Legal Centre, we now feel the time is right to venture out further into the South West area of London. We see a lot of potential in the Knightsbridge area of London and we believe we can offer the exact same services and quality of case handling as we have in West London. Investors/venture capitalists/funding assistance is needed. We are appealing to investors in ideas and people, venture capitalists and individuals within local authorities for funding assistance. We have been on the verge of closure for sometime now. Put simply our centre cannot operate and function for the forseeable future without an input of capital. Our centre has been providing hard hit individuals who do not know where to turn in desperate times for help. There have been times when this small residential centre has had to open at 7pm evening time after closing hours and Bobby Madan has had to go out of his family time to help someone. Mr Madan and the other 2 employees receive no wage or income and to keep up the cost of marketing i.e website, leaflets banners and expanding projects requires capital!. Mr Madan comments 'The centre has been open 3 years now. I have had the pleasure of funding the centre in the initial stages through family help. We invested considerably but we are now out of funding to keep this centre open. It is obviously against the wishes of the centre's clients as they know how hard it is to find legal advice for them out there without facing the cost of solicitors. We urge any potential investors that this is a worthwhile centre investing in. We have an excellent position on google which drives clients to the centre. However we just do not have the space or resources to expand our facility. We urge venture capitalists and investors to help us. We do not know if the government will. We have moved from the Himalaya Palace shopping Centre in southall. After almost a year at South Road Southall we do not believe the location was easily accesible to clients. There were issues relating to parking for the centre's clients and also due to lack of funding the cost of rental rates at South road southall were not affordable for a centre without government assistance. To date we do not receive any government grants and our employees for 3 years have been working unpaid.

We would like to bid farewell to Chiraag Pitrola who has been with the West London Legal Centre for a total number of 7 months. His determination, hard work and enthusiasm will be greatly missed by the team but we wish him all the best in his future endeavours and hope that he goes on to succeed in all that he chooses to do.

We would like to welcome Supervising Solicitor David Dunitz to the West London Legal Centre. Mr Dunitz has almost 17 years of experience working as a solicitor specialising in Family, Civil and general legal disputes. David joins us from the Hendon area where he formally practised as a solicitor in many leading high street firms. Since 2004, David is now a locum solicitor and assists the West London Legal Centre every Tuesday with regards to legal issues. It is a pleasure to have David on board our team and we believe his experience can be gained by all members of the team.
